The 5 Key Stages of Divorce
Although the paperwork differs slightly depending on how you apply, the overall journey is the same.

1. Starting the application
The process begins with an online application (usually via GOV.UK).
If you apply on your own, your spouse will be asked to acknowledge the application. This is called the Acknowledgment of Service, and they usually have 14 days to respond.
2. The 20-week reflection period
Once the application is issued, the court imposes a mandatory 20-week pause.
This isn’t just a delay. It’s designed to give you both time to:
Reflect on your decision
Begin sorting out finances
Make arrangements for any children
In reality, this period is often when the most important practical discussions happen.
3. Applying for the Conditional Order
After 20 weeks, you can apply for the Conditional Order.
This is the court confirming that you are legally entitled to divorce. You’ll also receive a Certificate of Entitlement, which is essentially the court’s approval to move forward.
It's important to reach this stage, as it's only at the point of Conditional Order that we can ask a Judge to approve an Order setting out your financial settlement.
4. A further waiting period
There is then a minimum wait of six weeks and one day before you can finalise the divorce.
This stage is particularly important from a legal perspective. Before applying for the final order, it’s wise to ensure your financial arrangements are properly resolved.
5. Final Order
The final step is applying for the Final Order (previously called the decree absolute).
Once this is granted, usually within a couple of days, the marriage is legally ended.
This outlines the full legal journey of divorce, from the initial application through to the final order. While structured, each stage carries practical and financial considerations that are important to approach carefully.
